Election officials in all 50 states urged to halt non-citizen voter registration: ‘Time to act is now’

The Post exclusively reveals that a conservative legal group sent letters Monday to all state officials urging them enforce laws prohibiting non-US citizens to register to vote or cast ballots during elections.

America First Legal (AFL), a non-profit organization, wrote to the chief elections officers, secretary of states, attorneys generals, lieutenant Governors, and governors of all 50 states on Monday to ask them to check immigration statuses of voters on voter lists using Department of Homeland Security information and to remove any non-Americans.

In the letter, Gene Hamilton, Executive Director of the AFL, said that if DHS does not respond to your inquiry you may sue the federal court for the information Congress has mandated DHS provide.

He added that “given the widespread public concern about the presence of foreigners on voter lists in jurisdictions throughout the United States, and the unprecedented levels of illegal migration across our southern border from January 20, 2021 to the present day, it is time to act now.”

The National Voter Registration Act of 1994 requires that states provide voters registration forms to welfare applicants who do not need proof of US citizenship.

The US Election Assistance Commission form only requires a signed declaration, under penalty perjury that the applicant is an American citizen.

Recent audits and investigations revealed that it is illegal for non-citizens to register as voters or to cast ballots at federal elections. However, tens thousands of them were found on the voter rolls.

Even in states such as Pennsylvania, where the outcome of elections is crucial, hundreds have voted without their knowledge.

By October this year, at least 8 more million migrants will be in the US. Many of them are eligible for welfare payments that could allow them to register as voters.

AFL President Stephen Miller accused Biden’s administration in a press release of “a direct effort to sabotage 2024 elections through mass illegal alien voting.”

According to Census Bureau data analyzed and compiled by the Center for Immigration Studies, a little over half (59%) of non-citizens receive at least one federal welfare benefit such as Supplemental Nutrition Assistance Program.

Biden supported this move during his presidential campaign in 2020.

State officials are also unable to provide DHS with information such as driver’s licence numbers or other easily identifiable data when trying to verify if a voter is a citizen who has not registered.

US Citizenship and Immigration Services processes the agency’s identifiers, such as Form I-94 arrival and departure numbers, Student and Exchange Visitor Information System ID numbers (SEVIS), naturalization cards or visa numbers. None of these are asked for on voter registration forms.

Five US states — Arizona Colorado Florida Georgia and Virginia — have signed memoranda to coordinate with CIS in order to verify the citizenship of applicants for voter registration.

Hamilton wrote: “It allows employees of the agency to quickly and easily look up individuals, and verify their citizenship status by using only their name and date-of-birth.”
