The riot took place at the border, and they were then welcomed to the US.

Immigration and Customs Enforcement confirmed to The Post that dozens of migrants accused of violently storming El Paso’s border on March 21, have been released.

The Post has released a video of 211 migrants rushing towards the US border, attacking Texas National Guardsmen trying to send them back to Mexico.

During the melee, at least one migrant could be seen stomping a knee of a military member.

A judge in El Paso dismissed all criminal charges against border crossers on May 15th, based on a technicality.

A spokesperson stated that the migrants who were accused of participating in the riots were released from state custody, and then handed over to ICE. ICE set 43 of them at liberty.

The spokesperson explained that ICE decides on a case-by-case bases who it will release.

“ERO [Enforcement and Removal Operations] Officers make decisions about associated enforcement actions and use prosecutorial discretion where applicable in a responsible way, informed by their experiences as law enforcement professionals and a manner that best protects our communities.”

A Homeland Security source, however, said that the reality was much more arbitrarily. According to the source, ICE allows migrants to enter the US because it can’t deport the immigrants fast enough.

Sometimes we arrest a child molester and release him because there is not enough housing. The source added that the charges may not be serious enough to warrant keeping the person in custody.

ICE released dozens migrants accused of taking part in the riot. However, it has also detained 32 other migrants pending court proceedings and 105 others pending removal.

The spokesperson confirmed that 43 more alleged rioters were successfully deported.

Border Patrol released two migrants shortly after Texas authorities had labeled them as the leaders of the riot.

One of the men was arrested, but the other, Venezuelan Gabriel Enrique Angarita Carrasquero (22), who allegedly pulled the gate with a rope, which led to a migrant influx, is still at large.

Texas armed state troopers and soldiers with non-lethal Pepperball Guns to try to prevent future violence along the border.

A National Guard source told The Post that soldiers now have “thousands of” pepperballs. They have also been instructed not to be timid when attempting to stop illegal incursions.

Sources said that the new tool has “made a huge difference here at the border,” and added that “soldiers feel so much safer.”
