NJ lawyer tossed out of town council meeting for waving American flag to protest new ban

Last week, a New Jersey lawyer was kicked out of a meeting of the town council by police for waving an American Flag to protest against a new “stupid rule” that prohibits using “props” during meetings.

New Brunswick Today obtained footage of Joel Bassoff, an attorney and local resident, being removed from the Edison Township Council Meeting after he pulled Old Glory out while speaking to council members in November 25.

Bassoff was one of a slew furious locals that voiced their objections against the new ordinance of the township, which prohibits the use of props during public comments at town meetings. This includes the flag or even the US Constitution.

Bassoff, who was a member of the Council at the time, said: “I am holding an American flag as a symbol of constitutional values.” Nishith Patel then banged the gavel on the table to issue an official warning.

The lawyer then continued, “It is my constitutional right to do so.” If you are sued, you’ll lose. I suggest that you seek a second opinion by a competent lawyer because you’re wrong.

You are interfering in the decorum of this gathering by interfering the right of speech of a public member. Bassoff was furious as residents cheered him on.

Two police officers approached Bassoff seconds later as the president of the council called for him be removed from chambers.

As Bassoff agreed, a resident shouted “Shame” at him.

The council president then ordered the police to remove the lawyer from the room.

A resident who had earlier held up the US Constitution was also removed.

Maryann Hennessey told the council that to consider the American Flag and Constitution as a prop, when they are raised, is an insult. It is a mockery of what the flag represents and what our country is.

“It is disgusting that you would use the American flag as a prop.”

Ordinance 2239 was passed recently in an effort to set rules for the often boisterous meetings of the township.

The rule does not specifically prohibit the American flag or Constitution. However, during the meeting the council president told residents that these items were “not conducive to good orders.”

The ordinance also limits the time that residents can address the body.
