Biden will announce Supreme Court reform plans next week

POLITICO reported that two sources familiar with the situation said President Joe Biden will unveil on Monday a proposal for a radical reform of the Supreme Court.
Biden will likely support establishing term limitations for justices, as well as an enforceable code for ethics. This is a significant shift for a President who has long opposed calls for reforming the Supreme Court.
He will also push for a constitution amendment that limits immunity for presidents and other officeholders. This is in response to a court ruling on July 1, which said that presidents were shielded from prosecution during their tenure in office for “official actions”. According to the anonymous people who spoke about internal planning, the specifics of the plan are still unclear and may change.
Biden will likely call for a major overhaul when he visits Texas and speaks at the Lyndon Baines Johnson Presidential Library in Austin.
The White House refused to comment, referring to Karine Jean Pierre’s comments on Thursday, that Biden believes “if you are in high office you should be required to be transparent, accountable and to be held to high ethics.”
Biden’s proposal comes at a time when he has become more critical of the Supreme Court, its rulings, and its conservative majority, which have ruled that federal abortion rights were eliminated, affirmative action was weakened in higher education, and stricter gun laws and other administration priorities are blocked.
Clarence Thomas, Samuel Alito and other justices have also been scrutinized for their conduct. Thomas did not disclose extravagant gifts and travel from wealthy Republican donors. Biden explained Wednesday that he had decided to give up his bid for a second presidential term by saying, “I will call for Supreme Court Reform, because this reform is crucial to our democracy.”
Legislation is likely to be required if term limits and an ethical code are to be imposed on the Supreme Court. It is unlikely that the divided Congress will take up this issue before the end year. Even if Democrats win both chambers in the upcoming elections, they will still fall short of 60 Senate seats to end a filibuster.
Even more difficult odds would be required for a constitutional amendment, which requires two-thirds approval from both chambers in Congress, or a convention convened by two-thirds the states as well as three-fourths the state legislatures’ approval.
Biden’s support for such major reforms will serve as the most clear signal that he shares the Democrats’ concern that the Supreme Court has become too partisan and at the expense its credibility among the American people.
