Trump calls for impeachment of judge who’s blocking deportation flights

On Tuesday, President Trump, along with other Republican members, initiated an impeachment campaign against a federal judge, whom Trump criticized as a “troublemaker and agitator” for interfering with his efforts to deport Venezuelan gang members. Chief Justice John G. Roberts Jr. expressed strong disapproval of using impeachment as a means to counter judicial decisions.

The situation has intensified, becoming a focal point in the ongoing legal opposition to President Trump. Critics of the president argue that he is ignoring a judge’s directives, while the White House contends that U.S. District Judge James Boasberg is compromising national security. Both parties have suggested that this conflict could lead to a constitutional crisis.

President Trump, who has previously faced two impeachment trials, suggested the idea of impeachment on social media, stating, “This judge, like many of the Crooked Judges I am forced to appear before, should be impeached!!! We don’t want vicious, violent and demented criminals, many of them deranged murderers, in our country,” emphasizing his point by using all caps.

Although Trump did not mention Judge Boasberg by name, it was clear he was referring to him. In response, Chief Justice Roberts released a statement highlighting that impeachment should not be used as a tool for disagreement over judicial rulings, noting that the normal appellate review process is designed for such disagreements.

Trump’s legal team is already pursuing the appellate process, having requested the U.S. Circuit Court of Appeals for the District of Columbia to disqualify Judge Boasberg from the case due to what they claim is an unprecedented judicial interference in presidential powers concerning national security. However, the appeals court has yet to respond to Trump’s request.

Over the recent weekend, Judge Boasberg attempted to stop deportation flights that were transporting hundreds of Venezuelans to El Salvador. The Trump administration justified these removals by citing the 1798 Alien Enemies Act and the president’s inherent powers as commander in chief, especially after declaring Tren de Aragua, a Venezuelan gang, as a foreign terrorist organization.

Judge Boasberg ordered the halting and return of flights already in the air so he could review the legality of Trump’s actions. Despite this, three deportation flights were executed, transferring the deportees to El Salvador, which agreed to detain them. A Homeland Security official confirmed that one flight departed after the judge’s order, noting that all individuals on board were already subject to deportation by an immigration judge’s order.

In a recent hearing, Judge Boasberg pressed the Justice Department for more details about the deportation flights, and subsequently demanded that the government disclose more information to him.

President Trump criticized Judge Boasberg on social media, pointing out that he was an appointee of President Obama and not elected by the public, asserting, “I’m just doing what the VOTERS wanted me to do,” as he wrote.

Supporting Trump’s stance, Republican Rep. Brandon Gill from Texas introduced an article of impeachment against Judge Boasberg on Tuesday, accusing him of creating a constitutional crisis by obstructing Trump’s lawful deportation efforts.

Democrats, however, view these impeachment calls as attempts to undermine judges who have obstructed Trump’s policies. Rep. Jamie Raskin of Maryland, a leading Democrat on the House Judiciary Committee, sided with Chief Justice Roberts, advocating for further judicial proceedings rather than impeachment to address unfavorable rulings.

The controversy surrounding Judge Boasberg has even reached international levels, with Salvadoran President Nayib Bukele mocking the judge for his inability to stop the deportation flights, posting “Oopsie… Too late,” on social media. Bukele also shared a video depicting the harsh treatment of the deportees upon their arrival in El Salvador.

Further scrutiny has been directed at Judge Boasberg’s family, with his wife being a founder and board member of an abortion clinic, and his daughter working for an organization that aids criminal defendants. In 2014, Chief Justice Roberts appointed Judge Boasberg to the Foreign Intelligence Surveillance Court, a secretive body overseeing government surveillance programs.
