Sen. Marshall Pushes To Define ‘Male’ And ‘Female’ In New Legislation
I didn’t expect to need legislation in order to be told that there are two genders, but here we are.
Kansas Senator Roger Marshall introduced on Wednesday a bill that targets the core tenants in transgender ideologies by defining “male”, “female”, and “sexuality” as “biological truth”.
The “Defining Male & Female Act of 2024”, would enshrine the biological differences between women and men in law. The legislation is supported by conservative groups and says that the definition is needed to combat the “increasing ambiguity about sex being a biological fact.”
Marshall reiterated this goal to The Daily Wire.

“As a doctor who has delivered more than 5,000 babies, i can say with confidence that politicizing children’s gender in order to use them as pawns for their radical woke ideology is not only wrong but it is also extremely dangerous. Marshall said, “I didn’t expect that we would have to pass legislation in order to be told there are two genders: males and females. But here we are.”
Marshall is the latest Republican who has introduced legislation on this topic. Rep. Nancy Mace, R-SC, introduced this month a bill to prevent men from using the women’s restrooms in the U.S. Capitol. This bill would prevent incoming Democrat Rep. Sarah McBride, a man who identifies himself as a female, from using the same bathroom as his female colleagues.
Marshall’s bill notes that “every individual is either male or female” and that “in no case is an individual’s sex determined by stipulation or self-identification.” It defines a female as “an individual who naturally has, had, will have, or would have, but for a congenital anomaly or intentional or unintentional disruption, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.”
The definition of a male is: “An individual who has, had or will have the reproductive system at some point that produces, transports and uses sperm to fertilize, whether by natural means, unintentional or intentional disruption.”
A “woman” is an “adult female human” and “a man” is an “adult male human.”
Marshall’s bill is supported by Idaho Republican Senators. James Risch, Mike Crapo, and Sen. Cindy Hyde-Smith are all Republicans from Mississippi. Rep. Mary Miller, R-IL, is expected to introduce a bill companion in the House. Conservative groups such as Heritage Action, Family Research Council and Concerned Women of America support the proposal.
