Five voters filed a petition on Thursday to remove former President Donald Trump’s name from the Illinois Republican Primary Election ballot in March. They claim he is not eligible to hold office as he encouraged the attack on the U.S. Capitol on Jan. 6, 2021 and did nothing to stop it.

The petition, like those filed in over a dozen states, relies upon the 14th Amendment of the Constitution. This amendment prohibits any person from holding an office if they have taken an oath before to defend the Constitution but then “engaged in rebellion or insurrection” against the nation or “given aid or comfort” to their enemies.

The 87-page, five-person document signed by people across the state argues that Trump, who lost the 2020 presidential election to Democrat Joe Biden in November, fanned flames among his hardline supporters, who attacked the Capitol the day Congress certified election results. Five people were killed and over 100 others injured in the riot.

Colorado and Maine officials have already removed Trump’s name off the ballots for primary elections. On Wednesday, Trump asked the U.S. Supreme Court to overturn a Colorado Supreme Court decision from December that removed his name from the state ballot.

Matt Dietrich, a spokesperson for the Illinois State Board of Elections, said that they had not yet scheduled a hearing on Thursday afternoon. At its meeting on Jan. 11, the board will hear 32 more objections to this proposed ballot.
