Pennsylvania: Court Rules in Favor of Signature Verification for Mail-In Voting

The U.S. 3rd Circuit Court of Appeals ruled that signature verification is required for voting by mail in Pennsylvania.

The U.S. 3rd Circuit Court of Appeals, in a 2-1 decision by three Democrat appointed judges, overturned a prior ruling from a Federal District Court that struck down a ruling of the Pennsylvania Supreme Court of 2022 that required a dated signature requirement for mail-in votes. According to the RNC:

The RNC, NRCC and PAGOP won this case in November 2022 before the Pennsylvania Supreme Court. In November 2023, a federal district court struck down the requirement for dated signatures. The RNC appealed and the U.S. 3rd Circuit Court of Appeals agreed with their argument.

The ruling was 2-1, and three judges appointed by Democrats made it. This ruling has far-reaching consequences for left-wing attempts across the country to weaponize the Materiality Provision of the Civil Rights Act. It also represents a win for mail ballot protections in an important swing state.

The ruling stated that “the Pennsylvania General Assembly decided that mail-in ballots must be dated on the envelope return to make the vote valid.” The Supreme Court of Pennsylvania unanimously ruled that this rule was mandatory. Failure to comply with it renders a vote invalid under Pennsylvania law.

Pennsylvania RNC Chairman Michael Whatley has hailed this decision as “a crucial victory for election integrity”.

This is a major victory for the integrity of elections and for voter confidence both in Pennsylvania and across the country. Pennsylvanians should feel secure about the security of their mail-in ballots. This 3rd Circuit decision rejects illegal left-wing attempts at counting incorrectly or undated mail ballots. Republicans will continue to win in court for election integrity ahead of the 2020 election.
