GOP report recommends Liz Cheney criminal probe over alleged Jan. 6 committee witness tampering

House Republicans said Tuesday they wanted a criminal prosecution of former Rep. Liz Cheney.

The report, released on Tuesday, on the select panel that investigated the riots of Jan. 6, at the U.S. Capitol not only condemned the “failures” and “politization” of the now disbanded panel, but also accused Ms. Cheney, of witness tampering.

The 128-page document, authored by Georgia Republican Rep. Barry Loudermilk calls for an FBI probe of Ms. Cheney in relation to the testimony of Cassidy Hutchinson a former White House assistant.

The interim report says that it is “unusual — and possibly unethical –” for a member of Congress to contact a potential witness when they know the person is represented by a legal representative.

Report notes that Ms. Hutchinson’s first lawyer advised her to tell the panel that she did not remember much of the events from the day, but she later changed her mind when she switched attorneys.

According to the report of Mr. Loudermilk, Alyssa Griffin, another former White House assistant, was a backchannel for the two women, changing lawyers and testimonies.

The report notes that Ms. Hutchinson contacted Ms. Cheney who, in her book, noted that she had advised the aide that “everyone deserves an attorney that will exclusively represent their interests.”

A report published in The Hill stated that a successful prosecution against Ms. Cheney based on the facts presented would be difficult.

One thing that Ms. Cheney can do is invoke her immunity under Section 107 of the U.S. Constitution. This clause bars criminal charges or suits against Congress members for their work.

Other problems exist.

The Hill reported that “witness tampering” could be a tricky charge in court because it involves encouraging witnesses to lie or change their stories. While the report also suggests certain aspects of Hutchinson’s testimony were incorrect — such as her relaying an account told to her from others who claimed to have seen Trump lunge at the driver — the report does not make recommendations about her.”

Ms. Cheney has criticized both the report in its entirety and the FBI’s call to investigate her.

This “Interim Report” deliberately ignores the truth, the Select Committee’s weighty evidence and fabricates falsehoods and defamatory accusations in an effort to cover up the actions of Donald Trump. They have not reviewed the evidence and their accusations are a cowardly and malicious attack on the truth. “No reputable lawyer or legislator would take this serious,” she said.
