The issue came to the forefront in 2018 following a legislative change by the Scottish Parliament, which mandated that women must comprise 50% of the representatives on public boards in Scotland. Subsequently, Scottish authorities expanded this definition to include transgender women who possess a Gender Recognition Certificate, thereby legally recognizing their female status under the Equality Act, to fulfill these quotas.

The redefinition by Scottish officials was contested by For Women Scotland (FWS), a women’s rights advocacy group. They argued that this interpretation exceeded the powers of Parliament and could lead to scenarios where public boards might consist of 50% biological men and 50% men with gender recognition certificates, yet still claim to meet the female representation requirements. Trina Budge, director of FWS, highlighted the potential distortion of the original intent of the law, stating, “Not tying the definition of sex to its ordinary meaning allows for a misrepresentation of actual female participation on these boards.”
