The Supreme Court has issued a temporary suspension on the Trump administration’s application of the Alien Enemies Act to a group of Venezuelan nationals located in North Texas. This decision came after the American Civil Liberties Union (ACLU) escalated the matter to the Supreme Court following unsuccessful attempts in lower federal courts on Friday.
The order from the Supreme Court, released early Saturday, mandates that the government is prohibited from deporting any member of the affected class of detainees until the Court issues further directives. Notably, Justices Clarence Thomas and Samuel Alito expressed their dissent regarding this decision.
Background of the Case
The ACLU’s legal challenge arose after the Trump administration informed several migrants at the Bluebonnet Detention Center in Anson, Texas, that they were subject to the Alien Enemies Act. This raised immediate concerns about potential rapid deportations.
The Alien Enemies Act, established in 1798, allows for the swift deportation of migrants from nations with which the U.S. is at war or those attempting an invasion. Recently, President Donald Trump applied this act to the Venezuelan gang Tren de Aragua, labeling their actions as an invasion, which led to the deportation of Venezuelan nationals to a facility in El Salvador last month.

Following President Trump’s invocation of the Alien Enemies Act, there have been numerous legal challenges against the administration’s actions. The Supreme Court previously ruled that while the act could be used to deport members of Tren de Aragua, all affected individuals must be given proper notice and due process. Additionally, federal judges in the Southern Districts of Texas and New York have temporarily halted the use of the Alien Enemies Act, pending further court hearings.
