‘We Will See You in Court, Mr. President’: Texas Governor Readies for Battle With DOJ over Rio Grande ‘Floating Barrier’

The Department of Justice intends to sue Texas for the construction of floating devices on the Rio Grande River to prevent illegal immigrants from entering the United States easily from the Southern border.

In a letter sent to Governor Greg Abbott on Thursday, Assistant Attorney General Todd Kim wrote: “We are writing to inform you…that we intend to file [a] lawsuit in relation to State of Texas’s illegal construction of a float barrier in the Rio Grande River.”

The note was obtained first by NBC News Friday. It stated that “The State of Texas’s actions violate federal laws, raise humanitarian issues, present serious risk to public safety, the environment, as well as interfere with federal government’s capability to carry out official duties.” The United States will take legal action if Texas does not “expeditiously” remove the structure before 2:00 pm.

The buoy barrier, which is about 1,000 feet long, is located near Eagle Pass, Texas, a major border crossing point. The DoJ believes that the construction of this barrier could violate the Rivers and Harbors Act.

The construction of the structure started in early July, as part Abbott’s plan for halting the flow of illegal immigrants through Operation Lone Star. According to reports, the Texas legislature has allocated almost $10 billion for this initiative.

The governor responded to the news by tweeting that Texas has the authority under both the U.S. Constitution as well as the Texas Constitution to defend its border. “We sent the Biden administration numerous letters outlining our authority, such as the one that I personally handed to President Biden in early this year.”

The tragic humanitarian crisis at the border was caused by Biden’s refusal of securing the border. His open-border policies encourage migrants risking their lives to cross illegally across the Rio Grande instead of safely crossing legally over a Bridge.

“Texas has stepped up to tackle this crisis. We will continue to use every possible strategy to protect Texans, Americans and migrants who risk their lives. “We will see you in Court, Mr. Presiden.”
