Jair Bolsonaro is under investigation in Brazil for allegedly harassing a whale off Sao Paulo

The former Brazilian president Jair Bolsonaro faces an investigation after allegedly “harassing” a humpback while riding on a personal watercraft near Sao Paulo last year.

Bolsonaro met with police officers in Sao Paulo, Brazil on Tuesday. He was accompanied by his former adviser and lawyer who were also present during the alleged incident.

The investigation is only one of many legal problems that the former far-right politician is currently facing. Bolsonaro, who left office in January 2017, has been barred from running for public office until 2030. He is also being investigated for plotting to unseat his successor and has lost his passport.

In a video from 2023 that has been circulated online, a man can be seen riding his personal watercraft near a whale and recording it with a phone. Federal prosecutors who are investigating the case said that the man looked like Bolsonaro.

According to Brazilian law, motorized vessels must maintain a distance of at least 100 meters between themselves and whales or other cetaceans. If you intentionally try to get close to whales or other cetaceans, you could be sentenced to up to five years of prison and fine.

Last year, prosecutors stated that the man in the personal watercraft appeared to be around 15 meters away from the animal.

Bolsonaro has made this argument many times since he left office.

Bolsonaro was questioned by police in Brasilia last week for allegedly planning a coup in order to remove his successor Luiz Inacio Lula Da Silva from power. Bolsonaro chose to keep silent after his passport was confiscated in a prior police operation.

Documents from the Supreme Court show that investigators think Bolsonaro, along with some of his top aides including former ministers and military advisors, prepared a declaration that would have declared 2022’s election votes fraudulent, if Bolsonaro had lost to his leftist rival, Lula.

The decree also called for the arresting of a Supreme Court Justice and convening a new elections. Bolsonaro won, but no decree was issued and the alleged plans were never implemented.

A panel of judges also ruled Bolsonaro ineligible for running for office until 2030, concluding that he abused his powers and cast unfounded suspicions about the electronic voting system used by Brazil.

Bolsonaro and his wife, as well as close aides, were questioned by investigators in another case last year. This was after Bolsonaro and his wife attempted to smuggle in jewelry worth a reported $3 million, and sold two luxury watches Bolsonaro had received from Saudi Arabia when he was in office.

The police are also investigating Bolsonaro’s political rivals and the alleged spying by the national intelligence agency during Bolsonaro’s term which ends in December 2022.

Bolsonaro denies any wrongdoing.

Legal experts believe that Bolsonaro could only risk a fine if the police prove that Bolsonaro deliberately approached the whale. G1 reports that a local politician convicted of similar charges in the same place was fined just over $500.
