Republican senators are filing a complaint in Georgia against Democrat Fulton County district attorney Fani Willis who is prosecuting the former president Donald Trump along with 18 other defendants on charges of trying to subvert Georgia’s 2020 elections results.

Senate Bill 92 was signed by Republican Governor. Brian Kemp created the Prosecuting Attorneys Qualifications Commission in May. The commission can punish or remove district attorney for a variety of reasons, including “willful conduct” or “persistent refusal” to follow law.

The complaint, reviewed Monday by The Atlanta Journal-Constitution, was filed by a group of eight GOP senators that includes Senate Majority Leader Steve Gooch, R- Dahlonega, and state Sen. Jason Anavitarte, R-Dallas, chair of the majority caucus.

The complaint alleges that Willis “improperly cherry picked cases to advance her personal political agenda”, and requests the commission to launch an investigation and to take “appropriate” measures to sanction her.

The complaint was filed just hours after the new law went into effect on Oct. 1.

Journal-Constitution reported that the complaint did not mention Trump specifically, but sought to link a series of deaths at Fulton County Jail, Atlanta, to Willis’ decision “to appoint a special grand jury to investigate her political opponents” amid an years-long backlog of cases.

Willis, who has criticised the law as racist, retaliatory and discriminatory, refused to comment via a spokesperson to the Journal-Constitution.

Kemp, who is a strong supporter of law and has often argued with Trump about the timing of these charges, criticised the timing.

“I’ve seen nothing that she did that broke the law or our procedures.” Kemp told the Journal-Constitution that she was honest about this. It may have been a political act in certain ways, such as the timing, but that doesn’t make it illegal.
